These Terms of Service (“Terms”) govern your access to and use of the QAMARI online store, products and related services (the “Services”). By placing an order or using the Services, you agree to these Terms.

2. Shopify Platform

Our store is hosted by Shopify Inc., which provides the ecommerce platform that enables us to sell our products to you. Your use of the checkout and related infrastructure is also subject to Shopify’s terms and privacy notices.

3. Eligibility & Accounts

  • You must be at least the age of majority in your jurisdiction to purchase.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Orders & Acceptance

All orders are offers to purchase and are subject to acceptance by QAMARI. We may refuse or cancel any order (e.g., suspected fraud, pricing/stock errors, restrictions to your delivery address). If we cancel after you’ve been charged, we’ll promptly issue a full refund.

5. Pricing, Taxes & Currency

Prices shown to EU consumers are inclusive of VAT (where applicable). Any shipping charges, duties or import taxes for non-EU destinations will be shown or notified before you complete the purchase, where reasonably determinable; otherwise, they are the responsibility of the recipient. The total price is displayed before you confirm payment.

6. Payment

You authorize QAMARI (and Shopify’s payment processors) to charge your selected payment method for the total order amount. If your payment is declined, the order may be cancelled.

7. Shipping & Delivery

We dispatch orders within 24 hours on business days. Delivery time estimates are shown on our Shipping & Delivery page. Estimates are not guarantees; delays can occur due to carrier, customs or peak periods. Risk of loss passes to you upon delivery to the shipping address you provided. If a parcel is returned due to incorrect or incomplete address information supplied by you, re-shipping costs may apply.

8. Returns, Exchanges & Right of Withdrawal (EU/UK)

You may return or exchange within 30 days of delivery, provided items are unused, unworn and in original condition with all protective films, manuals and packaging included.

  • Return shipping costs are paid by the customer.
  • Refunds are processed to the original payment method after inspection of returned goods.
  • For EU/UK consumers, your statutory 14-day right of withdrawal applies in addition to our 30-day policy. You must inform us of the withdrawal within 14 days of delivery; we will refund within 14 days of receiving the goods back (or proof of return shipping).
  • You can use the Model Withdrawal Form provided on our Returns & Exchanges page (or include equivalent information in your email).
  • Returns may be refused if items show wear, scratches, missing protective films, damage caused after delivery, or incomplete packaging.

9. Warranty & Conformity

Consumers in the EU/UK benefit from statutory conformity rights. If a product is defective or not as described, contact us and we will remedy in accordance with applicable law. This statutory warranty exists in addition to any commercial warranty displayed on the product page (if any).

10. Product Information

We try to be accurate, but errors, inaccuracies or omissions (including pricing, availability and descriptions) may occur. We reserve the right to correct any errors and to change or update information without prior notice.

11. Reviews & User Content

If you submit reviews or content, you grant QAMARI a non-exclusive, royalty-free license to use, reproduce and display them in connection with the Services.

Authenticity of reviews: we may send post-purchase invitations and apply manual moderation to help ensure reviews come from genuine purchasers and meet our guidelines. We do not publish reviews that breach our content standards (e.g., hate speech, personal data, spam).

12. Prohibited Use

You may not misuse the Services, interfere with security features, scrape data, reverse-engineer, or use the Services for unlawful, infringing or fraudulent purposes.

13. Intellectual Property

All trademarks, names, logos, product designs, text, images and other materials on the Services are owned by or licensed to QAMARI and protected by IP laws. No rights are granted except as necessary to use the store to purchase products.

14. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud). Subject to the foregoing and to the maximum extent permitted by law, QAMARI shall not be liable for: (a) indirect, incidental, special or consequential damages; (b) loss of profits, revenue, goodwill or data; and (c) any amount exceeding the price you paid for the product concerned.

15. Privacy & Cookies

We process personal data as described in our Privacy Policy. By using the Services, you consent to that processing. Cookie choices can be managed via our consent tools.

16. Changes to the Services or Terms

We may update the Services and these Terms from time to time (for example, to reflect legal or operational changes). The latest version is posted on this page with the “Last updated” date. Your continued use after changes constitutes acceptance.

17. Complaints & Disputes (EU ODR)

We aim to resolve issues directly. If you have a complaint, please email contact@qamariwatches.com. EU consumers can also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

18. Governing Law & Jurisdiction

These Terms and any disputes arising out of or in connection with them are governed by the laws of The Netherlands, without regard to conflict-of-law rules. Consumers may bring proceedings in the courts of their habitual residence, as required by applicable consumer protection law. Otherwise, the courts of The Netherlands shall have non-exclusive jurisdiction.

19. Severability & Entire Agreement

If any provision is held invalid, the remaining provisions remain in full force. These Terms, together with our Privacy Policy and any policy referenced herein, constitute the entire agreement between you and QAMARI regarding the Services.
